What's Required for a Hospital Notarization

This is the part families most want to understand ahead of time, because it determines whether the appointment can go forward. Three things have to be true.

The signer has to be aware and able to communicate. A notary confirms that the person signing understands what they're signing and is doing so willingly. The signer doesn't need to be in perfect health, but they do need to be conscious, coherent, and able to communicate their intent — by speaking, or by another clear and consistent means. If someone is heavily sedated, unconscious, or unable to respond, the notarization cannot proceed. This protects the signer, and it's a standard every notary in California is bound to.

The signer has to have valid ID. A current government-issued photo ID — driver's license, state ID, or passport. If the ID is at home, have a family member bring it. There are limited alternatives in some cases, so if ID is a problem, tell us when you call and we'll talk through options.

The signer has to sign in the notary's presence. The signature happens at the appointment, not before. Please don't have the document signed in advance.

We understand these situations are often emotional and time-sensitive. Knowing these three things ahead of time is what lets the appointment go smoothly the first time.

Timing and Same-Day Requests

A Few Things That Help the Appointment Go Smoothly

Have the documents ready and complete, but unsigned. Have the signer's photo ID on hand. If the document names specific witnesses in addition to a notary, arrange for them to be present. And if you're unsure whether your document even requires a notary, send us a photo first — some, like certain advance directives, may not, and we'll tell you honestly rather than have you arrange something you don't need.
